Supreme Court issues notice to Advani, others in Babri demolition case

A bench headed by Chief Justice H L Dattu issued notices to the BJP leader and the CBI on a separate plea filed by Haji Mahboob Ahmad, one of the petitioners in the Babri mosque case.

Ahmad, in his plea, has alleged that CBI may dilute its stand in the wake of the change in the government at the Centre.

Earlier, the CBI had moved the Apex Court against Allahabad High Court's verdict on dropping conspiracy charge against Advani and 19 others in Babri mosque demolition case.

During the brief hearing, CBI on Tuesday sought time for filing a fresh affidavit on delay in filing the appeal and on the merits of the case.

Former PM Manmohan Singh, Kumar Mangalam Birla move SC against summon orders

On 11th March, special CBI court summoned the former Prime Minister as an accused in a coal scam case. Industrialist Kumar Mangalam Birla, former coal secretary P C Parakh and three others were also summoned as accused.

The court summoned them for offences of criminal conspiracy, breach of trust and under provisions of Prevention of Corruption Act. They have all been asked to appear before the court on April 8.

In September 2005, Parakh recommended the allocation of the Talabira-II and Talabira-III coal blocks jointly to Hindalco, Mahanadi Coalfields and Neyveli Lignite. Hindalco is an Aditya Birla Group firm. The-then prime minister, who was holding the additional charge of the Coal Ministry, had approved the proposal in October that year.

In October 2013, the CBI had filed an FIR in which it named Parakh and Birla for criminal conspiracy and criminal misconduct. The CBI had filed its closure report in the case in August 2014, citing lack of evidence of wrongdoing against the duo.

However, the Supreme Court had in September last year pulled up the CBI for being in a hurry to close the case. The investigating agency filed its revised report in October.
Later in November, the CBI said that it has enough material on record to take cognisance of the offences.

However, the court asked the CBI as to why the former prime minister was not examined and in December directed the agency to record Manmohan Singh's statement.

CBI arrests BJD MP, 2 ex-MLAs in chit fund scam case

The agency arrested Hansdah, MP from Mayurbhanj in Odisha, along with Subarna Naik--former MLA of BJD and Hitesh Kumar Bagartti--former BJP MLA in connection with the scam.

The trio were alleged to be founder directors of Nabadiganta Capital Services which ran the chit fund through which thousands of investors were allegedly duped.

CBI sources said the three politicians have been arrested by its Special Investigation Team for alleged criminal conspiracy, cheating and diversion of funds.

The agency had on October 26 arrested the CMD of the ponzi company, Anjan Baliarsing, and directors Pradeep Patnaik and Kartik Parida in connection with a case registered against the company.

Nabadiganta Capital Services is one of the 44 companies under the scanner of the investigating agency for its alleged involvement in the multi-crore chit fund scam in Odisha.

The politicians had claimed that they had resigned from the firm as directors in 2012, but the resignations were accepted only last year.

While the trio had pleaded innocence and alleged that they had been framed by the ponzi company, the Nabadiganta CMD had told reporters, "The leaders are not children who can be framed. I have submitted all evidence to the CBI relating to their involvement in the company affairs."

CBI has formed a Special Investigating Team (SIT) headed by Joint Director Rajeev Singh to also probe the role of Securities Exchange Board of India (SEBI) and RBI.'

Ishrat case: CBI gives documents to Law Ministry

Ishrat case
Top CBI sources said fresh set of documents as desired by the Ministry have been provided to know whether it needs sanction of the Home Ministry to prosecute four IB officials in the fake encounter case.

The sources, however, clarified that their supplementary charge sheet is almost ready and if the Law Ministry does not give timely advice, it might consider proceeding ahead with filing of the final report before the competent court.

The government's legal arm had told CBI to bring sufficient documents before a legal opinion can be provided on whether prior sanction is required to prosecute Special Director Rajinder Kumar (now retired), and three other officers -- P Mittal, MK Sinha and Rajiv Wankhede.

CBI had recently approached the Law Ministry through the Department of Personnel and Training (DoPT) seeking its opinion on the issue.

It is learnt that when the Ministry demanded the documents, CBI informed it that it would share the documents with the Attorney General but could not give copies as the papers were sensitive in nature.

CBI says it has gathered enough evidence about the alleged role of the IB officers in the conspiracy behind the encounter but there are contrary views on whether sanction from the Home Ministry is needed to prosecute them.

One view is that since Kumar was in active service at the time of the alleged crime, sanction for his prosecution is needed from the Home Ministry, which is the cadre controlling authority.

Another opinion is that since he retired from service in July this year, the agency could go ahead with its charge sheet without any need for a sanction to prosecute.
