Rajnath advises Kejriwal to give up confrontational attitude, says NCT Act governs capital

Kejriwal has been advised not to resort to confrontation and has been explained that rules framed by the Home Ministry were in accordance with the Government of National Capital Territory of Delhi Act, the sources said.

The advice came when Kejriwal told the Home Minister about the difficulties being faced by the Delhi government in the wake of the ongoing tussle with LG Najeeb Jung over transfer and postings of bureaucrats, official sources said.

During the hour-long meeting, Kejriwal and Sisodia sought the Home Ministry's cooperation in running the Delhi government and conveyed to Singh that because of the constant tussle with the LG, smooth functioning of the administration has become tough.

The sources said Kejriwal asked the Home Minister to intervene and ensure that all issues with the LG are resolved amicably.

"The Home Minister gave them a patient hearing and assured full cooperation from the central government," a source said.

Singh also asked Kejriwal to resolve all issues with the Centre and the LG amicably through cooperation as government can function only through rules, regulations and cooperation.

Sisodia told reporters after the meeting that they have raised all issues concerning Delhi but there is no outcome.

This is the first time Kejriwal has met the Home Minister since the tussle between the AAP government and the LG over the appointment of senior IAS officer Shakuntala Gamlin as acting Chief Secretary.

Delhi deadlock: What Constitution says

Whatever will be the result of the tussle between Kejriwal and Jung, one thing is clear that the ambiguity over the powers of Delhi government is not going to end soon.

We are listing here few points mentioning the case of Delhi in Indian Constitution:

1. Delhi is not a full-fledged state and as per Schedule I of the Constitution it is a Union Territory.

2. But amendments to the Constitution have ensured that Delhi (and Puducherry) enjoys a special status among UTs.

3. So, while in other UTs, the will of Parliament is supreme, in the case of Delhi, which has its elected assembly, the state legislature has the right to legislate on all subjects except some such as law and order and land.

4. In case of a conflict between a law enacted by the Delhi Assembly and one enacted by Parliament, the latter  prevails.

5. The LG has the power to seek information about any matter which is likely to bring the Government of the NCT of Delhi into controversy with the Central government or with any state government.

6. Rule 45, which deals with the LG’s “Executive Functions”, allows the LG to exercise his powers in matters connected to ‘public order’, ‘police’ and ‘land’ in consultation with the Chief Minister.

7. In case of difference of opinion between the LG and the Council of Ministers, the LG must refer it to the Central government for “the decision of the President”, and is bound to abide by it.

8.  Under Clause 55 (2), subject to instructions issued by the Central government, the LG is bound to make a prior reference to the Centre with regard to proposals for the appointment of Chief Secretary and Secretary (Home) and Secretary (Lands).

People want governance and not controversy. So they should understand their responsibilities and fulfil people's expectations," he added.

Farmer suicide: Congress demands FIR against PM Modi, Kejriwal

"A case abetment of suicide should be lodged against the central government and the state government... The two persons who can be held most responsible for the suicide are Prime Minister Modi and Chief Minister Kejriwal," party spokesperson Satyavrat Chaturvedi said at the AICC briefing here.

His remarks drew a volley of questions from media persons who sought to know the justification of his demand and asked whether former Prime Minister Manmohan Singh and former Agriculture Minister Sharad Pawar can also be held accountable for suicide of farmers in the country when they were at the helm of affairs.

"The suicide happened in presence of the Chief Minister and (personnel of) Delhi Police, which is under the control of the central government... The Prime Minister did nothing to prevent it. Then who else is responsible for it?" he asked.

To repeated questions as to how can the Prime Minister be held responsible for the suicide and how logical it is to demand registration of FIR against him, the Congress leader argued that he is responsible for "creating a situation that led the farmer to commit suicide. Who else (is) responsible for it? He should be held responsible legally as well."

"The Prime Minister is particularly responsible for this incident as the situation that has led to it is continuing for months. The Prime Minister did not take the steps, which he should have taken. Investigation must take place, FIR must be filed against him. Nobody is above the law," Chaturvedi said.

Remo's decision to quit politics will affect AAP

Remo Fernandes ( picture courtesy Twitter)
"Yes it will be a setback but Remo's heart is with Aam Aadmi Party and its principles," party spokesperson Oscar Rebello told a press conference on Saturday.

Remo, who was initially being talked about as the party's candidate for the South Goa constituency, opted to take backseat after a mere two month stint with the party. The musician claimed that his participation in active politics was squelching his music.

"Even as a normal party worker, however I gave 100 percent of my time and mind-space when I did get involved (with AAP) because that is my nature... But the mind space required in politics is full of... well, politics. External, and most unfortunately internal. Enough to kill music in me forever," Remo said in his Facebook post announcing his resignation.

Rebello said while Remo may not be available for active politicking duties, he did not rule out the musician attending some of the key public meetings organized by the party.

AAP magic waning? Shazia, Vishwas discontent over tickets distribution

Shazia Ilmi, Kumar Vishwas
Things are yet to be decided within AAP camp regarding Lok Sabha polls and several leaders have already started showing signs of discord. Poet-turned-politician Kumar Vishwas, who has been fielded against Congress vice-president Rahul Gandhi, is now questioning the modus operandi of the party.

Expressing chagrin over functioning of the AAP and old party workers getting marginalized, another key AAP leader and well known former journalist Shazia Ilmi also joined the Vishwas bandwagon. Shazia is said to be upset with Kejriwal for not awarding her ticket for fighting Lok Sabha polls from Delhi.

Meanwhile, Kejriwal, maintaining a tough stand, has drawn a parallel between the rebels and his latest pot-shots taken at Bharatiya Janata Party’s prime ministerial candidate Narendra Modi.

More skeletons emerged out of closet on Tuesday after Kumar Vishwas expressed his annoyance over distribution tickets for Lok Sabha polls. Pouring out his ‘displeasure, Kumar wrote on micro-blogging website Twitter – “If dirty waters make its way into a river, even those holding reverence towards it will have apprehensions before taking holy dip.”

According to sources, Kumar Vishwas tried to speak to party leader Sanjay Singh and Kejriwal regarding distribution of party tickets several times but his views were not given any importance.

The AAP could face fire over selection of candidates and Kejriwal may find it difficult to come up with any convincing explanation this time.

Shazia Ilmi, who wishes to contest Lok Sabha polls from the national capital, is disappointed for not getting ticket. Such has been the extent of her discontentment that she even refused to contest against Congress president Sonia Gandhi from Rae Bareilly. However, Shazia in a tweet said that she never wished to contest from Delhi.

Amid all these developments, Kejriwal has been quite hard-nosed over his stand and he is determined not to give in before Shazia or Kumar Vishwas. In this very context, Kejriwal wrote on Twitter, “Ever since I trained my guns on Narendra Modi, things started unfolding in a very interesting manner. Several relationships are donning new meanings but truth will triumph.”

Sources close to Kejriwal believes that the ex-Delhi chief minister will not compromise a bit on his stand.

LS polls: AAP to field candidates against A Raja, Dayanidhi Maran

AAP symbol
"Definitely, we will field candidates against leaders who are dipped in scams. We will field candidates against A Raja in Nilgiris and Dayanidhi Maran in Central Chennai," AAP's Tamil Nadu convenor David Barunkumar told reporters in Chennai.

He said that the first list of candidates and constituencies would be released later this week. "We hope the first list of candidates will be announced by this Sunday or Monday", he said.

On whether anti-nuclear activist SP Udhayakumar, who has joined the AAP, would contest the polls in the wake of several cases filed against him, David said, "We will support Udhayakumar. Even if he is arrested, he will file his nominations from jail and contest the elections.”

On being asked whether AAP would try to forge a partnership with the Left parties in Tamil Nadu in the wake of their snapping ties with ruling AIADMK, he alleged that they were ‘not living upto the principles of communist parties’.

The meet also saw journalist Vaseegaran joining AAP in the presence of state office bearers of the party.

Kejriwal keeps AAP’s big guns away from Delhi

AAP's big guns have stayed away from Delhi
One of Kejriwal’s close aides, Kumar Vishwas is working at length in Amethi after he was given ticket to take on Congress vice-president Rahul Gandhi. Similarly, other senior leaders like Gopal Rai, Shazia Ilmi and Sanjay Singh have also been kept away from Delhi.

In Delhi, most of the AAP candidates for the LS elections were common party workers till few days back, who worked really hard in their areas to create a name for themselves.

AAP had already made it clear that they won’t give LS tickets to their sitting MLAs from Delhi and that is why senior leader Manish Sisodia had been kept away from the Delhi Lok Sabha elections.

There were speculations that contrary to their party principles, Kejriwal and Ilmi might contest elections from South Delhi and New Delhi constituencies but once AAP released its fourth list on Monday, the matter was settled.

The top leaders from AAP, who are close to Kejriwal, would be working to strengthen the organization at the grass root level.  Their responsibility would also include creating a wave in favour of their LS candidates in Delhi.

Delhi HC stays AAP Cabinet’s waiver on power bills

Delhi HC stays AAP Cabinet’s waiver
A bench of Acting Chief Justice BD Ahmed and Justice Siddharth Mridul issued notice to the standing counsel of the Delhi government and issued directions to file an affidavit stating its ‘current stand’ before the next date of hearing on March 18.

"Notice to respondent 1 (Delhi government). Respondent 1 to file counter affidavit indicating its current stand within 10 days. Meanwhile, there will be stay on decision of February 12, 2014 of Cabinet of National Capital Territory of Delhi," the bench said.

The High Court, which passed the order after going through the affidavit filed by the government as per the bench's February 19 order, expressed its unhappiness over the contents.

"This is no stand. This is the past. This is history. Tell us the present," the bench said after going through the affidavit.

Earlier on February 19, the bench had directed the standing counsel for the Delhi government to seek instructions and file an affidavit indicating the actual position regarding the proposal of the then Aam Aadmi Party (AAP) government. The court had passed the order as there was "no clarity" on whether the Delhi Cabinet had taken a decision to implement the subsidy as claimed by petitioner Vivek Sharma.

It was hearing a PIL, filed by advocate Vivek Sharma, challenging the subsidy given by former AAP government to people, who did not pay their power bills from October 2012 to December 2013.

After going through the government file, the bench had earlier observed that a note by former chief minister Arvind Kejriwal had said the subsidy proposal needed to be placed before the Cabinet. However, the High Court had also noted that while it appeared no decision had been taken, there is no clarity on that.
